Medicaid Planning

If your loved one is in a hospital or rehabilitation center and suddenly you find they will not be able to return to their home, our firm is able to (on a relatively short notice) get them qualified for the government benefit of medicaid, to help pay for the expensive cost of the nursing home or rehabilitation center, or to help with the assisted living facility. One does not have to be indingent nor are they required to spend their last dime to be qualified for medicaid assistance. Medicaid will not be able to take your loved ones home nor other assets with proper medicaid planning and asset protection documents in place prepared by a qualified elder law attorney.

Medicaid pays almost the entire cost of nursing home care for those who qualify. Regulations pertaining to eligibility are complex and confusing, and many people do not know what to do. They think that they must spend down their assets or purchase an annuity. These actions are often unnecessary. For couples with only one spouse in a nursing home, there are significant financial protections for the spouse who remains at home (i.e., the “community spouse”).
